Fun Forest Netherlands BV

These terms and conditions apply to agreements entered into on or after April 1, 2023.

General

In these terms and conditions, the following definitions apply:

Service: the agreed upon services including activities and rentals.
Activity: climbing, Forest Adventures, supping, canoeing, workshops, clinics, etc.
Rental: rental of materials for the above activities and rooms or spaces.
Client: any person who enters into an agreement with the company for himself or on behalf of third parties.
Guest: any person participating in or using a service and any person present on the premises.
Company: the company offering services or the company with whom the customer concludes the agreement. These companies are Fun Forest Almere BV, Klimpark Fun Forest Amsterdam BV, Fun Forest Rotterdam BV, Klimpark Fun Forest Venlo-Tegelen BV and Spider City NL BV.
Agreement: the agreement (including these general terms and conditions) between the company and client, pursuant to which the company provides its services to client and guest.
House Rules: the set of rules regulating order and safety on the premises and during services.
Land: the land under the management of or in use by the company, including buildings and installations.
Written: in writing or by electronic means (including e-mail).
Start time: we ask you to be present 15 minutes before the start time of the activity and to have picked up your climbing equipment no later than 10 minutes before the start of the instruction. If you are late for your reserved instruction time, we will see if there is room in a later instruction session. You will then choose to wait and climb for a shorter time. Under no circumstances are you entitled to reschedule your booking or receive a refund.
Weather conditions(in case of rain, climbing can be done as usual): We may decide to close our venue(s) for safety reasons due to expected
weather conditions. This may be the case of storms, thunderstorms and/or high winds. Should this be the case, we will contact you by phone. In consultation with you, we will move the booking to another date and/or time free of charge. Are you already busy with an activity at one of the locations and due to the weather conditions an evacuation is started, making
it no longer possible to continue the activity, then we apply the following conditions regarding refunds:

  • within 0-1 hour of instruction you will receive vouchers for the entire party;
  • within 1-2 hours of instruction you will receive vouchers for half the party;
  • within 2-3 hours of instruction you are not entitled to a refund.

Business Rules

The following company rules apply when using any of our services:

  1. If the participant(s) is/are under the age of 18, adult consent must be obtained before using our services. If the client makes reservations or bookings for minors, the client is responsible to fully inform the legal representative(s) of the minor guest about the services taken and the application of the terms and conditions and house rules. The client is responsible for obtaining permission for participation from the legal representative(s).
  2. When booking for multiple people, the main booker is responsible for sharing the terms and conditions with all participants. The main booker warrants us free of liability if the terms and conditions have not been shared with the other participants.
  3. Use of our services is entirely at your own risk. The liability of the company and Fun Forest Netherlands BV, even in the case of serious injury or death, will be limited to the amount covered by the liability insurance taken out by the company and Fun Forest Netherlands BV, plus the excess. Neither the company nor Fun Forest Netherlands BV will accept liability for property or financial loss, barring intent or wilful recklessness. Any personal injury sustained must be reported to the manager on the day of the activity(s).
  4. The activities may require considerable physical exertion and concentration. The guest must be in adequate physical condition and have no physical or mental (health) limitations that pose a risk to the safety of themselves or others. If in doubt, the guest should discuss in advance with their own physician whether it is safe to participate. Participation in the activity(s) in the event of pregnancy, visual and physical limitations (including but not limited to back problems) or in the event of medical treatment is entirely at one’s own risk and is not recommended from the Company. Damage or injury resulting from the company’s own overestimation of fitness and/or existing health problems is excluded from the company’s liability. Also, damage resulting from deliberate disregard of instructions is excluded from our liability.
  5. For your personal safety, wearing jewelry (earrings, necklaces, bracelets, (belly button) piercings, etc.) is not allowed during the activities. Also, it is not allowed to bring cell phones and/or (photo) cameras during climbing due to the risk of personal injury to other visitors of the climbing park. Long hair must be tied with an elastic band in a low ponytail or low bun. Wearing closed footwear is mandatory, and climbing with flip-flops or sandals is therefore not permitted.
  6. If the company staff deems it necessary for safety or other weighty interests, it may end the activity(s) early or prohibit further participation by the guest as well as deny access to the premises.
  7. Each participant must participate in the joint practical and theoretical safety instruction before entering the park. Participants and spectators must follow instructions and orders from company personnel at all times. Violation of these company regulations, failure to follow safety instructions or misconduct may result in denial of access to the climbing park.
  8. Participation in any of the activity(s) at the company is not allowed under the influence of alcohol, drugs, medications or other narcotics.
  9. The materials provided by the company (such as: helmet, harness, lifelines with carabiners, pulley, SUP board, canoe, etc.) must be used as directed by the staff. The materials must not be transferred to others. No smoking is allowed in the vicinity of the climbing equipment. If climbing equipment is taken off, one should have the climbing equipment checked by a company employee before climbing again.
  10. The duration of the activities is described on our website, for climbing this time includes the safety instruction. At the end of the specified time, the materials used must be returned. If this time is exceeded, the company reserves the right to charge a surcharge of €5 per person per half hour.
  11. The management reserves the right to close the venue if situations arise that make it impossible to ensure safety (fire, storm, thunderstorm, or heavy winds, etc.). In such cases, you are entitled to a refund as described in these general terms and conditions. If a participant breaks off their visit early themselves, they are not entitled to a refund.
  12. The company reserves the right to refuse guests access to the climbing park without giving reasons, with a refund of the entrance fees already paid.
  13. The company reserves the right to take and use photo and/or film recordings at any time for information and/or advertising purposes. If you do not wish to participate in this, you must expressly mention this at the reception desk. Taking photographs and/or making films for advertising purposes is prohibited without the written permission of Fun Forest Netherlands BV.
  14. Any guest’s claim for damages shall expire after one year. The claim expires after two years.

Booking conditions private individuals

These booking conditions apply to guests who have booked online at www.funforest.nl or through Fun Forest’s customer service, and who do not fall under the category of children’s parties or groups.

  1. Payment
    To complete your reservation, activities must be paid for immediately using iDEAL or Credit Card. You can choose to pay for your activity at the box office of one of the locations. Payment can be made there by pin or credit card. However, availability is then not guaranteed. We recommend booking and paying online to avoid disappointment.
  2. Discount
    If you are using a discount code or credit code, it must be used when booking online. Discounts cannot be settled afterwards. The relevant
    discount code or credit code must be turned in at the company checkout on the day of the activity. If you cannot prove the redeemed discount, you must pay the remaining amount at the box office. We do not give discounts on discounts.
  3. Participants
    When making the online booking, the number of participants must be known. If on the day of the activity there are fewer participants than the number you booked and paid for online, you will receive a credit note for the cancelled participants. For more information, see the terms and conditions regarding changing and/or canceling the booking.
  4. Canceling your booking
    Canceling your booking is free of charge up to 2 weeks before the activity. After that we apply the following cancellation policy:
    – Up to 1 week before the activity we will charge 50% of the booking;
    – Within 1 week of the activity we will charge 100% of the booking;
    – After rescheduling a booking, cancellation is no longer possible.
  5. Changing your booking
    Should you wish to change your booking or move it to another date and/or time this can be done by mutual agreement up to 48 hours before the activity. Changes can be made by contacting customer service by phone or e-mail. Changes areonly possible based on availability and with the exception of group bookings, children’s parties and catering arrangements.

Booking conditions groups

When we refer to “groups” in these booking conditions, this means a group of at least 20 people. This includes, among others: companies, schools, clubs, scouts, family days, groups of friends and bachelor parties.

  1. Reservations
    Making a reservation is possible through Fun Forest’s customer service. This can be done by filling out a contact form on the website www.funforest.nl, by phone or by e-mail. We offer you the possibility to place an option free of charge. The option will remain in place for 7 days. After the 7-day period, you will receive a reminder email from us. If after this reminder the option is not confirmed within 3 days, it will expire.
  2. Payment
    For groups, it is possible to pay by pin, credit card, iDEAL (payment link) or invoice. When confirming your option, a 50% deposit must be paid. The remaining amount can be paid on the day of the activity by pin or credit card. In the case of invoicing, you will receive the remaining invoice after the activity. This must be paid within a period of 14 days from the day of the activity.
  3. Discount
    Discounts are not valid for custom programs unless otherwise communicated.
  4. Changing or canceling your booking
    Changing or canceling your booking is free of charge up to 2 weeks before the activity. After that we apply the following modification and cancellation conditions:
    – Up to 1 week before the activity we charge 50% of the booking in case of cancellation. Moving to another date and/or time can be done free of charge in consultation with the company.
    – Within 1 week of the activity we charge 100% of the booking if cancelled. For relocation, we charge 10% of the booking value in addition to the cost of the booking.
    On the day of the activity, we reserve the right to issue refunds up to a maximum of 10% of the value of your booking.
    Groups: If we open specially and the number of participants falls below 20, then payment is required for a minimum of 20 participants (also with 10% arrangement).
    Schools: If we open special and the number of students falls below 25, then we must pay for a minimum of 25 students (also with 10% arrangement).
    Catering: The catering industry is excluded from the 10% rule. This is because of the procurement of this.

Booking conditions for children’s parties

  1. Reservations
    Children’s parties can be reserved through customer service or online at https://www.funforest.nl/kinderfeestjes/.
  2. Payment
    If you book through customer service, you will receive an iDEAL link in your confirmation and the full amount must be paid in advance.
  3. Discount
    Discounts do not apply to children’s parties. Unless otherwise communicated.
  4. Participants
    The children’s party arrangement can go ahead with a minimum of 6 participants. We understand that when organizing a children’s party it is difficult to give the exact number of children immediately. Therefore, we are accommodating you. We give you the space for 2 cancellations (taking into account the previously mentioned minimum number of participants).
    More participants: if more children want to participate, this is only possible if availability allows it. In that case we always advise you to call our customer service, they can inquire whether this is possible. This way you avoid disappointment at the box office.
  5. Canceling your booking
    Canceling your booking is free of charge up to 2 weeks before the activity. After that we apply the following cancellation conditions:
    – Up to 1 week before the activity we will charge 50% of the booking;
    – Within 1 week of the activity we will charge 100% of the booking;
    – After rescheduling a booking, cancellation is no longer possible.
