GENERAL TERMS AND CONDITIONS FUN FOREST NETHERLANDS B.V.

 

 

1. Definitions

In these terms and conditions, the following definitions shall apply:

  • Service means the agreed upon services, including activities and rental of materials or spaces.
  • Activity: including climbing, expedition, supping, canoeing, workshops, clinics, etc.
  • Rental: rental of materials, rooms or spaces.
  • Client: the natural or legal person who concludes an agreement with the company on behalf of himself or third parties.
  • Guest: any participant or attendee on the premises.
  • Company: Fun Forest Netherlands BV, Fun Forest Almere B.V., Klimpark Fun Forest Amsterdam B.V., Fun Forest Rotterdam B.V., Klimpark Fun Forest Venlo-Tegelen B.V. hereinafter referred to as Fun Forest.
  • Agreement: the agreement between client and company, including these general terms and conditions.
  • House Rules: the on-site rules for order and safety, as visible on the premises.
  • Land: the land and buildings in use by the company.
  • Written: written communication, including by electronic means such as e-mail.
  • Start time: the agreed upon start time of the activity or service.

2. Commencement and Timeliness

  • Guests should arrive at least 15 minutes before the start and report to the front desk no later than 10 minutes before the start.
  • Showing up late does not entitle you to an extension of the activity, rescheduling of the reservation, or refund of amounts paid.

3. Weather conditions

  • Activities may continue in light rain.
  • Fun Forest reserves the right to close locations during hazardous weather conditions such as storms, thunderstorms or high winds.
  • If closed, Fun Forest will contact you and the activity will be rescheduled free of charge.
  • If evacuated during an activity due to weather conditions, the following refund policy applies:
    • Termination within 1 hour of start: credit for entire party.
    • Termination between 1 and 2 hours after the start: credit for 50% of the party.
    • Termination after 2 hours: no refund.

4. Business Rules

4.1 Consent Minors

  • Participants under 18 may participate only with adult permission.
  • The client shall ensure that legal representatives are informed of these conditions and house rules.

4.2 Responsibility and Liability.

  • Participation is entirely at your own risk.
  • Fun Forest’s liability is limited to the amount covered by its liability insurance, plus the deductible.
  • Fun Forest shall not be liable for property or pecuniary damage, unless there is intent or willful recklessness.
  • Damage or injury must be reported to the supervisor on duty on the day of the activity.

4.3 Health and Safety

  • Participation requires sufficient physical and mental fitness.
  • People with health problems (such as pregnancy, back problems, visual impairments) are not advised to participate; in that case, participation is entirely at their own risk.
  • Damage caused by overestimating one’s own ability or ignoring instructions will not be covered by Fun Forest’s liability.

4.4 Safety measures

  • Wearing jewelry (earrings, necklaces, bracelets, piercings) is not allowed during activities.
  • Cell phones and (photo) cameras may not be taken while climbing.
  • Long hair should be tied low (low ponytail or bun).
  • Closed footwear is mandatory; flip-flops and sandals are not allowed.

4.5 Termination and Denial.

  • Fun Forest may refuse guest participation or terminate activities early if safety or other compelling interests require it.
  • Access may be denied for violation of company regulations, failure to follow safety instructions or misconduct.

4.6 Safety instructions

  • Each participant must participate in the practical and theoretical safety instruction through personal instruction or full viewing of the instructional video before participating in a climbing activity.
  • Participants and spectators must follow the directions of the staff at all times.

4.7 Use of Resources

  • Participation is prohibited while under the influence of alcohol, drugs, medications or other narcotics.
  • Materials (such as helmet, climbing harness, lifelines, SUP board, canoe, life jacket) are to be used only as directed.
  • Materials are not transferable.
  • Smoking is prohibited near climbing equipment.
  • If climbing equipment has been put back on (for example, after smoking or going to the toilet), it should be rechecked by an authorized instructor before starting to climb.

5. Duration and Cost of Activities.

  • The duration of the activity is described on the website and includes the total time spent performing the activity including safety instruction, donning materials, practice course climbing and returning equipment.
  • Exceeding the reserved time may result in a charge of €15 per person per half hour.

6. Site closure

  • Management may close sites if safety can no longer be guaranteed (e.g., fire, storms, thunderstorms).
  • In the event of closure by the company, the refund policy described above will apply.
  • Early termination by a participant does not entitle the participant to a refund.

7. Access and Photography

  • The company may refuse guests entry without giving any reason and refund any monies already paid.
  • Photo and film recordings may be used by Fun Forest, without explicit permission, for advertising purposes, unless otherwise indicated by the guest, explicitly, at the reception desk.
  • The taking of photographs and/or film recordings for advertising purposes by third parties, other than on behalf of Fun Forest, is not permitted without the written permission of Fun Forest.

8. Statute of limitations

  • Claims for damages are time-barred after one year.

BOOKING CONDITIONS PRIVATE INDIVIDUALS AND CHILDREN’S PARTIES

9. Applicability

These conditions apply to reservations made by individuals at www.funforest.nl, at on-site box offices or through customer service, including children’s party packages up to a maximum of 20 people.

10. Payment

  • Payment must be made directly at the time of online booking via iDEAL or credit card.
  • Payment at the box office can be made by debit card, but availability is not guaranteed then.
  • Fun Forest does not accept cash payments.
  • Online reservations and payment are recommended.

11. Discounts

  • Discount and credit codes must be processed immediately when booking online or booking at the box office; subsequent settlement of discount(s) is not possible.
  • Discounts are not valid on children’s party packages.
  • The discount code must be shown on the day of the activity; failure to show will require additional payment of the remaining amount.
  • Discount offers cannot be combined with other discounts and/or promotions.

12. Number of Participants

  • Reservations should include the correct number of participants.
  • A lower number of participants in the activity than reserved and/or paid will not entitle you to a refund.

13. Cancel and Modify.

  • Cancellations can only be made in writing at klantenservice@funforest.nl.
  • Free cancellation is possible until no later than 14 days before the start of the activity.
  • Cancellation from 13 days to 4 days before the start of the activity entitles you to a credit voucher worth the booked activities (excluding booked catering products).
  • Cancellation within 4 days before the start of the activity will not entitle you to a refund or credit.
  • After moving a booking, free cancellation is no longer possible. When canceling an already rescheduled booking, 100% of the booking value is due.
  • Changes or relocations can be requested up to 4 days prior to the activity and are subject to availability.
  • The number of participants of a final reservation can be reduced by a maximum of 10% and until no later than 4 days before the start of the activity.
  • Options are free of charge and valid for 7 days and expire no later than 14 days before the activity if not confirmed.

BOOKING CONDITIONS COMPANIES, SCHOOLS & ORGANIZATIONS

14. Reservation and Options

  • Group reservations are made through our website, customer service, by email or contact form.
  • A group reservation is considered at 20 participants.
  • Options are free of charge and valid for 7 days. An option expires no later than 14 days before the activity if not confirmed.
  • A reminder will be sent after 7 days; if no confirmation, the option expires.

15. Payment

  • With option confirmation, 50% deposit is required.
  • Once an agreement on the offer is given, we consider it a final booking. From that moment on, the modification and cancellation conditions apply.

16. Discounts

  • Discounts do not apply to group reservations and customizations unless specifically stated otherwise.

17. Cancel, Move and Modify.

  • Is only possible by email at klantenservice@funforest.nl
  • If cancelled up to 4 weeks before the start of the activity, we will charge 10% of the total cost
  • If cancelled up to 14 days before the start of the activity, we will charge 50% of the total cost
  • In case of cancellation within 14 days before the start of the activity, we will charge 100% of the total cost
  • If a booking is moved up to 4 weeks prior to the activity, we will not charge a fee in addition to the cost of the booking. Rescheduling is subject to availability only
  • If a reservation is moved up to 7 days prior to the activity, we will charge 10% of the total cost in addition to the cost of the booking. Rescheduling is subject to availability only
  • If a reservation is moved within 7 days before the activity begins, we will charge 25% of the total activities booked and 100% of the hospitality products booked in addition to the cost of the booking. Rescheduling is subject to availability only.
  • Changes to the reservation in program times and/or numbers can be made free of charge up to 7 days before the start of the activity and are subject to availability only. The number of participants can thereby be reduced by a maximum of 10%.
  • After rescheduling a booking, free cancellation of a booking is no longer possible. When canceling a booking that has already been moved, 100% of the booking value is due.

FINAL PROVISIONS

18. Applicable law and disputes.

  • All agreements are governed by Dutch law.
  • Disputes shall be submitted exclusively to the competent court in Amsterdam.

19. Changes to these terms

  • Fun Forest reserves the right to modify these terms and conditions.
  • The latest version is always available on the website and applies as of publication

20. Other provisions

  • If any provision is found to be invalid, the other provisions will remain in full force and effect.
    Fun Forest is entitled to engage third parties for the performance of its services.
