Definitions<\/h3>\n<p>In these terms and conditions, the following definitions shall apply:<\/p>\n<ul>\n<li><strong>Service means<\/strong> the agreed upon services, including activities and rental of materials or spaces.<\/li>\n<li><strong>Activity:<\/strong> including climbing, expedition, supping, canoeing, workshops, clinics, etc.<\/li>\n<li><strong>Rental:<\/strong> rental of materials, rooms or spaces.<\/li>\n<li><strong>Client:<\/strong> the natural or legal person who concludes an agreement with the company on behalf of himself or third parties.<\/li>\n<li><strong>Guest:<\/strong> any participant or attendee on the premises.<\/li>\n<li><strong>Company:<\/strong> Fun Forest Almere B.V., Klimpark Fun Forest Amsterdam B.V., Fun Forest Rotterdam B.V., Klimpark Fun Forest Venlo-Tegelen B.V hereinafter referred to as Fun Forest.<\/li>\n<li><strong>Agreement:<\/strong> the agreement between client and company, including these general terms and conditions.<\/li>\n<li><strong>House Rules:<\/strong> the on-site rules for order and safety, as visible on the premises.<\/li>\n<li><strong>Land:<\/strong> the land and buildings in use by the company.<\/li>\n<li><strong>Written:<\/strong> written communication, including by electronic means such as e-mail.<\/li>\n<li><strong>Start time:<\/strong> the agreed upon start time of the activity or service.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>2. Commencement and Timeliness<\/h3>\n<ul>\n<li>Guests should arrive at least 15 minutes before the start and report to the front desk no later than 10 minutes before the start.<\/li>\n<li>Showing up late does not entitle you to an extension of the activity, rescheduling of the reservation, or refund of amounts paid.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>3. Weather conditions<\/h3>\n<ul>\n<li>Activities may continue in light rain.<\/li>\n<li>Fun Forest reserves the right to close locations during hazardous weather conditions such as storms, thunderstorms or high winds.<\/li>\n<li>If closed, Fun Forest will contact you and the activity will be rescheduled free of charge.<\/li>\n<li>If evacuated during an activity due to weather conditions, the following refund policy applies:\n<ul>\n<li>Termination within 1 hour of start: credit for entire party.<\/li>\n<li>Termination between 1 and 2 hours after the start: credit for 50% of the party.<\/li>\n<li>Termination after 2 hours: no refund.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>4. Business Rules<\/h3>\n<p><strong>4.1 Consent Minors<\/strong><\/p>\n<ul>\n<li>Participants under 18 may participate only with adult permission.<\/li>\n<li>The client shall ensure that legal representatives are informed of these conditions and house rules.<\/li>\n<\/ul>\n<p><strong>4.2 Responsibility and Liability.<\/strong><\/p>\n<ul>\n<li>Participation is entirely at your own risk.<\/li>\n<li>Fun Forest&#8217;s liability is limited to the amount covered by its liability insurance, plus the deductible.<\/li>\n<li>Fun Forest shall not be liable for property or pecuniary damage, unless there is intent or willful recklessness.<\/li>\n<li>Damage or injury must be reported to the supervisor on duty on the day of the activity.<\/li>\n<\/ul>\n<p><strong>4.3 Health and Safety<\/strong><\/p>\n<ul>\n<li>Participation requires sufficient physical and mental fitness.<\/li>\n<li>People with health problems (such as back problems, broken bones, visual impairments) are not advised to participate; in that case, participation is entirely at their own risk.<\/li>\n<li>Participation during pregnancy is not permitted.<\/li>\n<li>Damage caused by overestimating one&#8217;s own ability or ignoring instructions will not be covered by Fun Forest&#8217;s liability.<\/li>\n<\/ul>\n<p><strong>4.4 Safety measures<\/strong><\/p>\n<ul>\n<li>Wearing jewelry (earrings, necklaces, bracelets, piercings) is not allowed during activities.<\/li>\n<li>Cell phones and (photo) cameras may not be taken while climbing.<\/li>\n<li>Long hair should be tied low (low ponytail or bun).<\/li>\n<li>Closed footwear is mandatory; flip-flops and sandals are not allowed<\/li>\n<\/ul>\n<p><strong>4.5 Termination and Denial.<\/strong><\/p>\n<ul>\n<li>Fun Forest may refuse guest participation or terminate activities early if safety or other compelling interests require it.<\/li>\n<li>For violation of company regulations, failure to follow safety instructions or misconduct, access may be denied&#8230;.<\/li>\n<\/ul>\n<p><strong>4.6 Safety instructions<\/strong><\/p>\n<ul>\n<li>Each participant must participate in the practical and theoretical safety instruction through personal instruction or full viewing of the instructional video before participating in a climbing activity.<\/li>\n<li>Participants and spectators must follow the directions of the staff at all times.<\/li>\n<\/ul>\n<p><strong>4.7 Use of Alcohol and\/or Drugs<\/strong><\/p>\n<ul>\n<li>Participation is prohibited while under the influence of alcohol, drugs, medications or other narcotics.<\/li>\n<li>Smoking is prohibited near climbing equipment.<\/li>\n<\/ul>\n<p><strong>4.8 Use of Materials<\/strong><\/p>\n<ul>\n<li>Materials (such as helmet, climbing harness, lifelines, SUP board, canoe) should be used only as directed.<\/li>\n<li>Materials may be passed on to others only if staff indicate so.<\/li>\n<li>If climbing equipment has been put back on (for example, after smoking or going to the toilet), it should be rechecked by an authorized instructor before starting to climb.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>5. Duration and Cost of Activities.<\/h3>\n<ul>\n<li>The duration of the activity is described on the website and includes the total time spent performing the activity including safety instruction, donning materials, practice course climbing and returning equipment.<\/li>\n<li>Exceeding the reserved time may result in a charge of \u20ac15 per person per half hour.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>6. Site closure<\/h3>\n<ul>\n<li>Management may close sites if safety can no longer be guaranteed (e.g., fire, storms, thunderstorms).<\/li>\n<li>In the event of closure by the company, the refund policy described above applies.<\/li>\n<li>Early termination by a participant does not entitle the participant to a refund.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>7. Access and Photography<\/h3>\n<ul>\n<li>The company may refuse guests entry without giving any reason and refund any monies already paid.<\/li>\n<li>Photo and film recordings may be used by Fun Forest, without explicit permission, for advertising purposes, unless otherwise indicated by the guest, explicitly, at the reception desk.<\/li>\n<li>The taking of photographs and\/or film recordings for advertising purposes by third parties, other than on behalf of Fun Forest, is not permitted without Fun Forest&#8217;s written permission.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>8. Statute of limitations<\/h3>\n<ul>\n<li>  Claims for damages are time-barred after one year.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h2>BOOKING CONDITIONS PRIVATE INDIVIDUALS AND CHILDREN&#8217;S PARTIES<\/h2>\n<h3>9. Applicability<\/h3>\n<p>These conditions apply to reservations made by individuals at <a href=\"https:\/\/www.funforest.nl\/en\/\">www.funforest.nl,<\/a> at on-site box offices or through customer service, including children&#8217;s party packages up to a maximum of 20 people.<\/p>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>10. Payment<\/h3>\n<ul>\n<li>Payment must be made directly at the time of online booking via iDEAL or credit card.<\/li>\n<li>Payment at the box office can be made by debit card, but availability is not guaranteed then.<\/li>\n<li>Fun Forest does not accept cash payments.<\/li>\n<li>Online reservations and payment are recommended.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>11. Discounts<\/h3>\n<ul>\n<li>Discount and credit codes must be used when booking online; subsequent settlement of discount(s) is not possible.<\/li>\n<li>Discounts are not valid on children&#8217;s party packages.<\/li>\n<li>The discount code must be shown on the day of the activity; failure to show will require additional payment of the remaining amount.<\/li>\n<li>Discount offers cannot be combined with other discounts and\/or promotions.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>12. Number of Participants<\/h3>\n<ul>\n<li>Reservations should include the correct number of participants.<\/li>\n<li>A lower number of participants in the activity than reserved and\/or paid will not entitle you to a refund.<\/li>\n<li>Adding more participants to a reservation is possible only when availability permits.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>13. Cancel and Modify.<\/h3>\n<ul>\n<li>Cancellations can only be made in writing at <a href=\"mailto:klantenservice@funforest.nl\">klantenservice@funforest.nl.<\/a><\/li>\n<li>Free cancellation is possible until no later than 14 days before the start of the activity.<\/li>\n<li>Cancellation from 13 days to 4 days before the start of the activity entitles you to a credit voucher worth the booked activities (excluding booked catering products).<\/li>\n<li>Cancellation within 4 days before the start of the activity will not entitle you to a refund or credit.<\/li>\n<li>After moving a booking, free cancellation is no longer possible. When canceling an already rescheduled booking, 100% of the booking value is due. <\/li>\n<li>Changes or relocations can be requested up to 4 days prior to the activity and are subject to availability.<\/li>\n<li>The number of participants of a final reservation can be reduced by a maximum of 10% and until no later than 4 days before the start of the activity.<\/li>\n<li>Options or offers are free of charge and valid for 7 days and expire no later than 14 days before the activity if not confirmed.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h2>BOOKING CONDITIONS COMPANIES, SCHOOLS &#038; ORGANIZATIONS<\/h2>\n<h3>14. Reservation and Options<\/h3>\n<ul>\n<li>Group reservations are made through our website, customer service, by email or contact form.<\/li>\n<li>Of a group reservation, there are 20 participants.<\/li>\n<li>Options are free of charge and valid for 7 days. An option expires no later than 14 days before the activity if not confirmed. <\/li>\n<li>A reminder will be sent after 7 days; if no confirmation, the option expires.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>15. Payment<\/h3>\n<ul>\n<li>With option confirmation, 50% deposit is required.<\/li>\n<li>Once an agreement on the offer is given, we consider it a final booking. From that moment on, the modification and cancellation conditions apply. <\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>16. Discounts<\/h3>\n<ul>\n<li>Discounts do not apply to group reservations and customizations unless specifically stated otherwise.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>17. Cancel, Move and Modify.<\/h3>\n<ul>\n<li>Is only possible by email at <a href=\"mailto:klantenservice@funforest.nl\">klantenservice@funforest.nl<\/a><\/li>\n<li>For <strong>cancellations<\/strong> up to 4 weeks before the activity we will charge 10% of the total cost.<\/li>\n<li>If <strong>cancelled<\/strong> up to 14 days before the activity we will charge 50% of the total cost.<\/li>\n<li>If you<strong> cancel<\/strong> within 14 days prior to the activity, we will charge 100% of the total cost.<\/li>\n<li>If a booking is <strong>moved<\/strong> up to 4 weeks prior to the activity, we will not charge a fee in addition to the cost of the booking. Rescheduling is subject to availability only. <\/li>\n<li>If a reservation is <strong>moved<\/strong> up to 7 days prior to the activity, we will charge 10% of the total cost in addition to the cost of the booking. Rescheduling is subject to availability only. <\/li>\n<li>If a reservation is <strong>moved<\/strong> within 7 days before the activity begins, we will charge 25% of the total activities booked and 100% of the hospitality products booked in addition to the cost of the booking. Rescheduling is subject to availability only. <\/li>\n<li><strong>Changes<\/strong> to the reservation in program times and\/or numbers can be made free of charge up to 7 days before the start of the activity and are subject to availability only. The number of participants can hereby be reduced by a maximum of<br \/>\nby 10%. <\/li>\n<li>After rescheduling a booking, free cancellation of a booking is no longer possible. When canceling a booking that has already been moved, 100% of the booking value is due. <\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h2>FINAL PROVISIONS<\/h2>\n<h3>18. Applicable law and disputes.<\/h3>\n<ul>\n<li>All agreements are governed by Dutch law.<\/li>\n<li>Disputes shall be submitted exclusively to the competent court in Amsterdam.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>19. Changes to these terms<\/h3>\n<ul>\n<li>Fun Forest reserves the right to modify these terms and conditions.<\/li>\n<li>The latest version is always available on the website and is valid as of publication.<\/li>\n<\/ul>\n\n  <\/div>\n    <\/div>\n\t\t\t\t\t\t\t\t\t\t\t\t<div class=\"content content--small   \">\n                          <div class=\"!text-inherit content--wysiwyg\">\n    <h3>20.
